Every case is different. These answers provide general information about drug charges in Texas. 

The potential charge and punishment depend on several factors, including the type of substance, its penalty group, the alleged weight, whether the State alleges possession or delivery, and the person’s criminal history. Certain locations and surrounding circumstances may also increase the possible punishment. 


Ownership is not the only issue. The State must prove that you knowingly possessed the substance. When drugs are found in a shared vehicle, home, or other location, the surrounding facts and the connection between the accused person and the substance can be especially important. 


Evidence obtained through an unlawful stop, detention, search, or seizure may be challenged. Whether suppression is available depends on the specific facts, including whether officers had a warrant, probable cause, valid consent, or another lawful basis for the search.
